A tenant can file a motion to stay at any time after an eviction notice is served.

The court can only stay an eviction order for up to ten days. Most justice courts allow the tenant to file only one motion to stay in any eviction case.

Avoid illegal eviction in India

A Motion to Stay (Delay) Order for Summary Eviction permits the inhabitant to ask the court to "remain" (stop) a summary eviction and grant the occupant up to ten additional days to move.

The Supreme Court of India has set out that proprietors can't expel an occupant for at any rate 5 years if the lease is being paid normally except if the landowner truly needs the property for himself/herself.
